Simpson County approves amended ordinance regulating data centers amid lawsuit

FRANKLIN, Ky. (WNKY) – Simpson County officials have approved an amended ordinance updating local zoning regulations for data centers and related energy systems.

The Simpson County Fiscal Court adopted the measure May 5 after a second reading, following a recommendation from the county’s planning and zoning commission. The ordinance defines “advanced technology centers” – including data centers – and allows them as conditional uses in both incorporated and unincorporated areas of the county.

That means such developments may be permitted, but only after additional review and approval through the planning and zoning process.

County leaders say the update is aimed at establishing clearer guidelines for large-scale technology projects.

“My fight is not necessarily against the data center,” Simpson County Judge-Executive Mason Barnes said previously at a hearing on April 13. “My fight is to make sure that if it is allowed to locate here, that we’re able to put in the safeguards and guidelines, rules and regulations to help our community stay safe.”

The ordinance was approved by a majority vote of the fiscal court and takes effect as Simpson County continues to see interest in potential data center development.
