Man charged with rape and sodomy of woman unable to consent

BOWLING GREEN, Ky. – A man is behind bars charged with rape and sodomy of an intoxicated individual.
On Halloween night or early into the next morning, the woman claims she was at a party and had been drinking a lot and blacked out, according to an arrest citation.
The next morning, the woman woke up and noticed her leggings and underwear had been removed.
The woman’s friend told investigators she saw the victim passed out on the bed without clothing on and heard the suspect unbuckling his pants at some point, according to the citation.
The woman confronted Gustavo Carias Salas, 21, of Bowling Green about the alleged rape to which he apologized and asked her not to call the police, according to his citation.
Carias Salas admitted to police that he had sex with the woman that night, according to the citation, but claimed she was not asleep during intercourse.
Carias Salas is charged with first-degree rape and sodomy of a victim incapable of consenting and is lodged in the Warren County Regional Jail.
