The Graves-Gilbert Clinic approved through court to exit bankruptcy

BOWLING GREEN, Ky. – The Graves-Gilbert Clinic announced Thursday it received approval from a court to avoid Chapter 11 bankruptcy.

In December 2022, the clinic had stated it would be filing for bankruptcy following a $21.3 million verdict in a medical malpractice case.

According to court documents, the medical malpractice case was originally filed on May 30, 2014 regarding complications suffered following a surgical procedure in 2013.

Court documents state the plaintiff was a woman who was 75 years old at the time of the surgery. The plaintiff spent months in the hospital following the surgical procedure and eventually went legally blind after a resulting infection reached her eye, court documents state.

“We will act on the lessons learned through this process and, going forward, how we can ensure high value medical care,” CEO Michael D’Eramo stated.

The clinic says it has a reorganization plan in place allowing it to pay vendors and establish a fund that will be shared among current “tort claimants.”

“It is important we ensure there are no disruptions in patient care, and the exit plan approval provides that opportunity,” Dr. Jerry Roy, president of The Graves-Gilbert Clinic, stated.

The approved terms will allow the clinic to continue providing healthcare services to south central Kentucky, according to the clinic.
