Judge dismisses lawsuit against apartment complexes
BOWLING GREEN, Ky. – A federal judge has dismissed a lawsuit filed by local apartment complexes against the United States Postal Service.
This ruling comes after a recent change in mail delivery left hundreds of Bowling Green apartment residents without mail distribution.
Originally, the United States Postal Service said in a statement to WNKY that they are prohibited from distributing mail to individual mailboxes in dormitories or residence halls, although the complexes argue they are neither.
The complexes sued based on a section in the USPS handbook saying if a mode of delivery is established incorrectly, but the customer is not notified within one year, then the customer would have to consent to a change in mode of delivery.
There are a few avenues the complexes can take now moving forward, according to the plaintiff’s Attorney Brian Lowder.
Apartment managers from at least four Bowling Green complexes have been rejecting delivered mail from the post office since early December of 2019 in order to ensure they are not viewed as agreeing with the change of delivery mode.
