Cave City data center lawsuits to move forward together

GLASGOW, Ky. (WNKY) – Two lawsuits involving the Kentucky Industrial Alliance and the city of Cave City are expected to be combined following a Monday morning motion hearing in Barren Circuit Court.

The cases, 26-CI-00445 and 26-CI-00500, are connected to a proposed data center development in Cave City.

The first lawsuit challenges Cave City’s 12-month moratorium on data center development.

KIA argues the city did not follow required planning, notice and public hearing procedures when the moratorium was adopted. The company also argues it had already submitted a development plan before the moratorium took effect.

KIA is seeking an injunction that would prevent enforcement of the moratorium and require its development plan to be considered under the zoning regulations that were in place before the moratorium.

Cave City has filed a motion asking the court to dismiss the case.

The second lawsuit, 26-CI-00500, involves the annexation of property connected to the proposed development and includes a dispute involving Shaw Cemetery.

No motions were pending in that case during Monday’s proceedings.

Barren Circuit Judge John T. Alexander is expected to issue an order combining the two cases in the coming days. The move is intended to streamline the litigation.

The next status conference is scheduled for Nov. 23.
